MEMBERSHIP AGREEMENT
1. Parties
a) www.misscix.com MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ, resident at MEHMET NESİH ÖZMEN MAH. GÜLSEVER SK. NO: 11 GÜNGÖREN/ İSTANBUL, which operates the internet site (hereinafter referred to as "www.misscix.com").
b) www.misscix.com the internet user who becomes a member of the internet site ("Member")
2. Subject of the Agreement
The subject of this Agreement is to determine the terms and conditions under which the Member shall benefit from the internet site owned by www.misscix.com, www.misscix.com .
3. Rights and Obligations of the Parties
3.1. The Member, www.misscix.com declares and undertakes that the personal and other information provided when registering as a member on the internet site is accurate before the law, and that they will immediately and fully compensate www.misscix.com for any damages it may incur due to the inaccuracy of such information.
3.2. The Member may not give the password provided to them by www.misscix.com to any other person or entity; the right to use the said password belongs exclusively to the Member. All liability that may arise from this, as well as all claims and demands that may be brought against www.misscix.com by third parties or competent authorities, shall be borne by the Member, and www.misscix.com reserves its right to compensation and any other claims arising from such unauthorized use.
3.3. The Member www.misscix.com accepts and undertakes in advance to comply with the provisions of applicable legislation while using the internet site and not to violate them. Otherwise, all legal and criminal liabilities that may arise shall be borne entirely and exclusively by the Member.
3.4. The Member, www.misscix.com may not, under any circumstances, use the internet site in a manner that disrupts public order, is contrary to general morality, disturbs or harasses others, serves an unlawful purpose, or infringes upon the intellectual property and copyrights of others. Furthermore, the Member may not engage in any activity or transaction (spam, viruses, trojans, etc.) that prevents or hinders others from using the services.
3.5. www.misscix.com The opinions and ideas declared, written, or used by members on the internet site are entirely the personal views of the members and are binding only upon the person expressing them. These opinions and ideas have no connection whatsoever with www.misscix.com. www.misscix.com bears no responsibility for any damages that third parties may suffer as a result of the opinions and views expressed by the Member, nor for any damages that the Member may suffer as a result of opinions and views expressed by third parties.
3.6. www.misscix.com shall not be liable for the reading of member data by unauthorized persons or for any damage that may occur to the Member's software and data. The Member, www.misscix.com has agreed in advance not to demand compensation from www.misscix.com for any damages that may be incurred as a result of using the internet site.
3.7. The Member has agreed not to access or use, without authorization, the software and data of other internet users. Otherwise, all legal and criminal liability arising therefrom shall belong entirely to the Member.
3.8. A Member who violates one or more of the provisions set forth in this membership agreement shall be personally liable, both criminally and civilly, for such violation, and shall keep www.misscix.com free from the legal and criminal consequences of such violations. Furthermore, in the event that the matter is referred to a court of law due to such violation, www.misscix.com reserves the right to claim compensation from the Member for non-compliance with the membership agreement.
3.9. www.misscix.com always has the right to unilaterally delete the Member's membership, as well as the customer's files, documents, and information, whenever necessary. The Member accepts this disposition in advance. In such a case, www.misscix.com shall bear no responsibility whatsoever.
3.10. www.misscix.com The software and design of the internet site are the property of www.misscix.com, and the copyright and/or other intellectual property rights relating thereto are protected by the relevant laws; they may not be used, acquired, or altered by the Member without authorization. Other companies and products mentioned on this website are the trademarks of their respective owners and are likewise protected under intellectual property rights.
3.11. For the purpose of improving and developing www.misscix.com the internet site by www.misscix.com and/or within the framework of applicable legislation, certain information may be collected, such as the name of the Internet service provider and the Internet Protocol (IP) address used to access the site, the date and time the site was accessed, the pages visited during the session, and the Internet address of the website that provided direct access to the site.
3.12. www.misscix.com may use members' personal information in efforts aimed at the specific preferences and interests of its users, in order to provide better service to its users, improve its products and services, and facilitate the use of the site. www.misscix.com, www.misscix.com reserves the right to keep a record of the Member's activities on the internet site.
3.13. The person who becomes a member of www.misscix.com declares and accepts that they permit product and service promotions, advertisements, campaigns, benefits, surveys, and other customer satisfaction practices to be presented to them by www.misscix.com and all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ (misscix.com), within the scope of practices currently in force and/or to be put into force. The Member declares and accepts that they permit their personal and shopping information, as well as their shopping and/or consumer behavior information, which they have provided in the past and/or will provide in the future while becoming a member of www.misscix.com and/or through other means, to be collected for the above purposes, to be shared with all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ, and to be used and archived by www.misscix.com and all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ. Unless the Member states otherwise, they declare and accept that they permit the collection, sharing with all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ, and use and archiving by www.misscix.com and all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ of their data even after their membership ends. Unless the Member states otherwise, they declare and accept that they permit www.misscix.com and all companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ to contact them using communication channels such as internet, telephone, SMS, etc. The Member declares and accepts that they will not make any claim regarding any direct and/or indirect, material and/or moral, negative and/or positive damage, or any damage whatsoever, arising from the collection, sharing, use, archiving of, and access to the aforementioned information, and that they will not hold www.misscix.com and companies affiliated with MİSS CİX TEKSTİL İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ liable. If the Member wishes to change their data sharing preferences, they may submit this request to www.misscix.com's customer service call center.
3.14. www.misscix.com may disclose the Member's personal information when required as a legal obligation, or in cases where it, in good faith, believes such disclosure is necessary in order to (a) act in accordance with legal requirements or comply with legal proceedings served on www.misscix.com; or (b) protect and defend the rights and property of www.misscix.com and the www.misscix.com family of websites.
3.15. Precautions have been taken, within available means, to keep the www.misscix.com website free of viruses and similar malicious software. In addition, in order to ensure ultimate security, the user is required to obtain their own virus protection system and provide the necessary protection. In this context, by entering the www.misscix.com website, the Member is deemed to have accepted that they are responsible for any errors that may occur in their own software and operating systems, and for the direct or indirect consequences thereof.
3.16. www.misscix.com reserves the right to change the content of the site at any time, to modify or terminate any service provided to users, or to delete user information and data registered on the www.misscix.com website.
3.17. www.misscix.com may at any time change, update, or cancel the terms of the membership agreement, in any manner and without any prior notice and/or warning whatsoever. Any provision that is changed, updated, or repealed shall take effect for all members as of its publication date.
3.18. The Parties accept and declare that all computer records belonging to www.misscix.com shall be taken as the sole and true exclusive evidence, in accordance with Article 287 of the Code of Civil Procedure (HUMK), and that the said records constitute an evidentiary agreement.
3.19. Pursuant to this membership agreement, www.misscix.com has the authority to send informational emails to the email addresses registered by its members and informational SMS messages to their mobile phones; upon approving this membership agreement, the Member shall be deemed to have accepted that informational emails will be sent to their email address and informational SMS messages to their mobile phone. Should the Member wish to stop receiving emails and/or SMS messages, they may cancel the sending of emails and/or SMS from the "My Preferences" section under "My Page."
4. Termination of the Agreement
This agreement shall remain in effect until the Member cancels their membership or until their membership is cancelled by www.misscix.com. In the event that the Member violates any provision of the membership agreement, www.misscix.com may unilaterally terminate the agreement by cancelling the Member's membership.
5. Resolution of Disputes
The Istanbul Courts and Execution Offices shall have jurisdiction over disputes arising from this agreement.
6. Effective Date
The Member's completion of membership registration means that the Member has read all the provisions contained in the membership agreement and has accepted the provisions set forth therein. This Agreement is concluded and mutually enters into force at the moment the Member registers as a member.
